Terms of Service for Pvpmania

Effective Date: June 23, 2025

Welcome to Pvpmania! These Terms of Service ("Terms") govern your access to and use of the Pvpmania game and its related services provided by Colmod ("we," "us," or "our"). By accessing, installing, or playing Pvpmania, you agree to be bound by these Terms, along with our Privacy Policy and End-User License Agreement (EULA), which are incorporated by reference.

1. Account Creation and Management

Account Responsibility: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Username Policy: You agree not to use any inappropriate, offensive, or otherwise prohibited names (including those containing curse words or hate speech) as your username or in-game display name. We reserve the right to modify or remove any such names.
Minimum Age: Pvpmania is intended for users who are suitable for ages 12 and above. By creating an account and playing the game, you represent that you meet this age recommendation or have obtained parental or guardian consent if you are under the age of majority in your jurisdiction.
Password Security: You must not share your account password or any other personal login information with anyone else.

2. Code of Conduct and Prohibited Activities

To ensure a positive and fair gaming environment for all players, you agree to adhere to the following Code of Conduct. The following activities are strictly prohibited:

Cheating & Hacking: Using any unauthorized third-party programs, scripts, or methods to gain an unfair advantage in the game, including but not limited to speed hacks, aimbots, wallhacks, or any other form of automation or modification of game data.
Exploiting Bugs: Intentionally using or benefiting from any game glitches, bugs, or unintended features to gain an unfair advantage.
Harassment & Hate Speech: Engaging in any form of harassment, bullying, stalking, threats, hate speech, discrimination, or any other disrespectful or abusive behavior towards other players or Colmod staff.
Spamming & Solicitation: Sending unsolicited messages, repetitive messages, or engaging in any form of advertising or commercial solicitation within the game.
Real-Money Trading (RMT): Attempting to buy, sell, trade, or exchange any in-game items, currency (including XP, Money, or Gold), or accounts for real-world money or value outside of authorized in-game mechanisms.
Sharing Personal Information: Sharing the personal information of other players without their express consent.
Offensive Language in Chat: While we recognize that some language may be used, players are solely responsible for their communications. We reserve the right to moderate, remove, or take action against any communication deemed excessively offensive, harassing, or in violation of these Terms. Use of offensive language is at your own risk and may lead to reports and penalties.
Interference: Disrupting the normal flow of gameplay or attempting to interfere with the enjoyment of the game by other players.
Unauthorized Access: Attempting to gain unauthorized access to any part of the game, its servers, or other players' accounts.

3. User-Generated Content (UGC)

Pvpmania allows users to generate certain content, such as in-game chat messages and in-game profile information (which are not custom profiles). By creating or transmitting any UGC within Pvpmania, you:

Grant Colmod a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such UGC in connection with the game and its promotion.
Represent and warrant that your UGC does not infringe on any third-party rights (including intellectual property, privacy, or publicity rights) and is not illegal, offensive, or harmful.
Acknowledge that Colmod has no obligation to monitor or moderate UGC but reserves the right to review, remove, or refuse to distribute any UGC at its sole discretion, without notice or liability.

4. Intellectual Property

All intellectual property rights in Pvpmania, including but not limited to all software, code, graphics, user interfaces, characters, stories, music, sound effects (except where licensed from third parties as detailed in our EULA), trademarks, and service marks, are owned by Colmod or its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the game for personal, non-commercial entertainment purposes only, as further detailed in our EULA.

5. Virtual Items and In-Game Currency

Pvpmania features in-game currencies and items, including XP (Experience Points), Money (in-game soft currency), and Gold (premium currency obtained via In-App Purchase and also earnable in-game). You acknowledge and agree that:

All virtual items and currency are licensed, not sold, to you and remain the property of Colmod.
Virtual items and currency have no real-world monetary value and cannot be redeemed for real currency, goods, or other items of monetary value from Colmod or any other party.
Your license to virtual items and currency is subject to these Terms, the EULA, and our Privacy Policy.
If your account is suspended or terminated for any reason, you may lose access to and forfeit any virtual items and currency associated with your account.

6. Service Availability and Updates

Pvpmania is currently in early development (approximately 3-4% complete) and is not yet ready for 24/7 online availability. While we strive to provide a continuous and enjoyable service, you acknowledge and agree that:

The game and its online services may be subject to scheduled or unscheduled maintenance, downtime, or interruptions.
We reserve the right to update, modify, or discontinue any aspect of the game or its services, including features, content, or availability, at any time without prior notice or liability.
We are not liable for any loss, damage, or inconvenience caused by service interruptions, maintenance, or discontinuation.

7. Account Suspension and Termination Policy

We reserve the right to suspend or terminate your account, or restrict your access to Pvpmania, if you violate these Terms or our EULA. Our disciplinary actions for prohibited activities are as follows:

First Offense: Account ban for a period of 10 days.
Second Offense: Account ban for a period of 30 days.
Third Offense: Account ban for a period of 60 days.
Subsequent Offenses: Each subsequent proven violation will result in an account ban increasing by an additional month (e.g., 90 days, 120 days, etc.).
Severe Violations: Under certain conditions, such as severe breaches of the Code of Conduct, repeated violations, or illegal activities, your account may be immediately and permanently terminated without prior bans.
Consequences of Termination: Upon suspension or termination, you will lose access to your account, all associated in-game progress, characters, virtual items, and currency. No refunds will be provided for any forfeited items or purchases due to violations of these Terms.

8. Disclaimers and Limitation of Liability

Pvpmania is provided "as is" and "as available," without warranties of any kind. We do not guarantee that the game will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law:

Colmod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the game.
You acknowledge that your actions and interactions within the game, including "raging and destroying stuff," are your sole responsibility. Colmod is not liable for any damages or consequences arising from your behavior or the behavior of other users.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

10. Dispute Resolution

Any disputes, claims, or controversies arising out of or relating to these Terms or your use of Pvpmania will be resolved through informal negotiation. You agree to first contact us at the email address provided below, or via our official Discord server, to attempt to resolve any issue informally. We will make reasonable efforts to resolve the dispute with you.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify all account holders of any significant changes by sending an email to their registered email address. Your continued use of Pvpmania after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using Pvpmania.
